Tivo Wins Another $200 Million Against Dish Network and EchoStar

Tivo has been awarded $200 million in damages in the lawsuit with Dish Network Corp. and EchoStar Corp. Tivo says that Dish Network stole its patented information to create its DVR service. The damages are on hold right now until Dish and EchoStar's appeal is heard. Tivo's original lawsuit asked for $1 billion in damages for the theft of its proprietary technology that allows viewers to pause, rewind and fast-forward live television.
"We are pleased by the Court's ruling to impose contempt sanctions of approximately $200 million against EchoStar for its continued violation of a Court-ordered permanent injunction," TiVo said in a statement. Dish and EchoStar, which are sister companies, remain optimistic about the appeals process.

"While we disagree that any amount of sanctions was warranted, the decision confirms our belief that we designed around Tivo's patent in good faith. We believe that we ultimately will prevail on appeal," the companies said in a joint statement. TiVo has largely won the cases held at the U.S. District Court for the Eastern District of Texas, although both sides have scored procedural victories in a parallel intellectual property case looked at in the U.S. Patent Office. A jury granted TiVo $103 million plus interest in June.
With prior rulings in the case, Tivo has been awarded around $400 million in damages, sanctions and costs.

Best Buy to Add TiVo to Insignia Tech Products

Insignia StripPCMag.com reports that Best Buy and Tivo Inc. have launched a marketing and DVR alliance.
The two companies will develop a TiVo interface for DVRs sold at Best Buy that will integrate the retailer's digital content services.

"Best Buy and TiVo will investigate development of a series of consumer tips and insights that can be easily accessed for all kinds of digital home experiences, and Best Buy expects to explore opportunities with TiVo to provide unique Best Buy solutions that enable viewers to take greater advantage of transactional opportunities through the television set," the two companies said in a statement.

What that actually entails has yet to be established, but in July 2008, TiVo teamed up with Amazon to let its customers purchase Amazon.com content from their TVs using the remote, so is a Best Buy purchase widget in the works?
The WSJ's Digits blog says Best Buy will be adding Tivo technology to its Insignia line of HD TVs.

TV Watchers Continue DVR Conversion

DVR sales are expected to soar over the next two or three years. TiVo Inc., the company that started DVRs in 1999, says its subscription base now exceeds 3 million. The Yankee Group, a Boston research firm, predicts that the number of DVR homes will rise from 7 million at the end of 2004 to 33.5 million by the end of 2008. By comparison USA Today reports that 100 million households currently own VCRs. The DVR is even causing dramatic changes in the workplace. USA Today has an article explaining how the DVR has brought office cooler discussions about TV shows to a screeching halt. Many people now Tivo TV shows to watch them at a more convenient time -- so they don't want to overhear the show's plot before they are able to see the show themselves. Advertisers are worried about the DVR device because it allows consumers to skip commercials. So, as a TV watcher you should expect product placement advertisements in TV shows to increase. So how much will a new DVR cost you? USA Todays says, "The price tag isn't basic cable: $100 and up to purchase a box, plus a $10-$13 monthly fee for a service such as TiVo, or, if part of a local cable system, just a monthly fee for the service." Many cable and satellite service providers (such as Time Warner, Comcast, Cox Communications, Dish Network and DirecTV) now include the option of a DVR as part of the service package as USA Today mentioned, so you might want to check with your cable provider before you purchase a new DVR.

Hardware Hacking

Hardware hacking is a new trend that involves people taking a piece of hardware, like a toaster, and enhancing it at home with new technology. For example, Scott Fullam redesigned his toaster to burn the words hot or cool onto the bread. Other items people like to hack include TiVo and the Xbox -- and just about any household appliance can be updated by adding a digital camera or digital display. Books available on hardware hacking are just starting to hit the bookstores.
