Chia Obama Pulled From Walgreens Stores

Chia Obama DeterminedA strange product called Chia Obama is being pulled from the shelves of some Walgreens stores in Florida, reports Fox News.
Some local Walgreen's stores are pulling a supposed likeness of President Barack Obama off their shelves. The 'Chia Obama' will no longer be sold there.

Walgreen's spokesman Michael Polzin explained to FOX 13 that local store managers have the ability to purchase and market products -- like the Chia Obama -- on their own.

But now, the corporate office has asked stores to pull the product from their stores because, he said, it is not appropriate for the company's corporate image.
Amazon.com and Drugstore.com are two retailers still carrying the Chia Obama which comes in both a "happy pose" and "determined pose." Chia Obama is just one of many strange Obama related products on the marketplace around the world. You can read about a few more here in an earlier post.

White House Wants to Limit Commercial Use of President's Likeness

Obama Action FigureBloomberg is reporting that the White House wants to control and limit the usage of the president's image. Bloomberg quotes White House spokeswoman Jen Psaki as saying, "Our lawyers are working on developing a policy that will protect the presidential image while being careful not to squelch the overwhelming enthusiasm that the public has for the president."
Psaki wouldn't provide details about legal options the White House counsel's office is considering to deal with commercial use of Obama's likeness.

The White House lawyers may have to make case-by-case determinations about the best ways to protect the presidential image without tempering enthusiasm or trampling on free-speech protections, said Jonathan Band, an intellectual property lawyer in Washington.

"It will be difficult," Band said. "Because he is the president of the United States and there was this campaign and everyone's proud, I think the First Amendment will be applied much more broadly with respect to people wanting to use an image of the president than it would be with typical entertainment figures or sports figures."
Princeton University historian Fred Greenstein told Bloomberg that newsworthy figures invite parody.
"Its par for the course," he said. Presidents have all been imitated, positively and negatively, in one form or another, he said. "When you have really newsworthy and dynamic figures they invite parody, they invite idolizations, they invite imitation in one mode or another."
It's unclear how exactly the White House could limit usage of the president's likeness on products. Legally they may not be able do very much because of free-speech rights, but it seems wrong that companies are using Barack Obama's image to suggest he is endorsing a brand. False advertising laws could help if corporations are alleging the President said something he did not say. There have been scads products created over the years featuring the likenesses of past presidents, without any White House interference.

Amazon.com Launches Inauguration Day Store

Amazon Inauguration Day StoreAmazon.com has launched an Inauguration Day store. Internet Retailer reports that the site carries everything from big-screen tvs to cardboard cutouts of the President-elect.
Once they are on the mircosite visitors can shop for electronics such as big-screen TVs, Obama-decorated ties or a life-size cardboard cutout of the President-elect and books on presidential history. The inauguration store also features a countdown to the event and a community forum where visitors can start a discussion or add to an existing one.

"A lot of people will be participating in the upcoming inauguration, whether they are planning to attend or host a party at home," says an Amazon spokesman. "We want to make it as easy as possible for customers to prepare for the historic event."
Barack Obama merchandise is one niche category that is sure to remain hot as we start out 2009. We reported earlier about a big store opening in D.C. that's main focus is selling Barack Obama products.

New D.C. Store Carries Obama Merchandise

Jim Warlick of Political Americana has opened a new store a block from the White House that carries tons of Barack Obama merchandise.
A 5,000 feet, wall to wall, ceiling to floor of Barack Obama

Almost everything you can think of t-shirts, buttons, and mugs.

Anthony Casolaro bought a baseball cap for his daughter.

Customer Anthony Casolaro says "she wants to go the inauguration but I told her she may have to join the other three million people on the lawn."

Customer Stephanie Gorski says "I got a t-shirt for my niece, which is just exactly what they wanted. They've been Obama fans forever. They're little kids, about four."
The timing is obvious with Barack Obama's inauguration just weeks away. The store even sells Obama hot sauce according to the CNN video below. The store plans to open a website later this month. Warlick says in the CNN clip that Obama's image will "be on more items than the Pope probably by the time this is over."
