Bratz Dolls Get a Reprieve
The Bratz Dolls have gotten a reprieve
of sorts. In the seemingly never-ending lawsuit between Mattel and MGA Entertainment over the dolls, a judge has ruled that MGA can sell the Bratz dolls through the end of 2009, even though they infringe on Mattel's copyright.
U.S. District Judge Stephen Larson "indicated he will be modifying his Dec. 3 stay ... to allow purchases and sales (of Bratz items)" beyond a previously set deadline of Feb. 11, MGA attorney Tom Nolan said.
MGA had asked Larson to postpone his order barring the company from selling products that infringe on Mattel's (MAT.N) copyrights until MGA can appeal the ruling to the Ninth U.S. Circuit Court of Appeals.
A Mattel representative had no immediate comment.
MGA told the court retailers were skittish about placing orders for spring and fall of 2009 because of uncertainty about whether the toys would be available, Nolan said.
MGA has invested "tens of millions of dollars" developing spring and fall Bratz lines and is awaiting orders from retailers in January, Nolan said.
"Retailers wanted assurances that if they buy them they can sell them," he said.
It was not immediately clear whether MGA would keep profits from those sales or if they would be placed in an escrow account until the appeals process is completed.
Our guess is that the money from the sales will be placed into an escrow account pending a determination as to how much is profit. Presumably, the profits will go to Mattel because it owns the rights to the dolls now.

The End of Bratz Dolls?

Mattel Inc. had a major victory in court: it got a court order stopping
MGM Entertainment for making or selling any Bratz dolls that have been found to infringe Mattel's copyright.
U.S. District Judge Stephen Larson in Riverside, California, yesterday granted Mattel's request to stop MGA from making most of its multiethnic fashion dolls that have contributed to a drop in Barbie sales since being first sold in 2001. A jury earlier found that a Mattel designer came up with the Bratz name and characters and secretly took the idea to MGA.
"Mattel has established its exclusive rights to the Bratz drawings, and the court has found that hundreds of the MGA parties' products, including all the currently available core female fashion dolls Mattel was able to locate in the marketplace, infringe those rights," Larson said in his ruling.
The judge also granted Mattel's request to order MGA not to use the name "Bratz." El Segundo, California-based Mattel asked for an injunction against MGA after a two-phase trial.
Mattel rose 66 cents, or 5 percent, to $13.86 in New York Stock Exchange composite trading. Shares have fallen 30 percent in the past year.
The jury found that ex-Barbie designer Carter Bryant came up with the Bratz idea and made most of the original sketches for it while he was still at Mattel. It awarded Mattel $100 million in damages, 5 percent of the $2 billion the toymaker sought.
MGA disputes the ruling and says it will appeal. But the judge said that the two companies need to stop fighting and reach a settlement. Mattel has had to fire 70 employees because of the costs of this lawsuit, according to one source. Profits from Bratz are disputed, but are somewhere between $405.4 million and $777.9 million. Bratz dolls will be sold until a February 11, 2009 hearing on post-trial motions.

Hanna Montana Moves Past Bratz on Top Toys for Girls List
Hannah Montana has jumped four places in this year's Top Toy survey from NRF which was conducted by BIGresearch. That's the Hannah Montana Holiday Singing Doll - sold here at Amazon.com - pictured on the right. Barbie maintains her top spot on the hot toys list for girls but Bratz dolls dropped to the fourth spot. Video games and High School Musical merchandise also appeared on the top ten list for girls this year for the first time. NRF says the top gifts for boys are similar to last year, with electronics taking the top spots in the form of video games and Nintendo Wii. Boys also wants Legos, cars, Star Wars, Hot Wheels and Transformers.

Mattel Suing MGA Over Bratz Dolls
Mattel is suing MGA Entertainment Inc., the company that makes Bratz, for stealing the idea of the Bratz doll. Mattel wants the Bratz line -- and its $500 million dollars in sales each year -- turned over to Mattel. The story is that Mattel created the Bratz dolls line, but scrapped the idea because of fears that it would steal market share from Barbie (boy, did that turn out to be true). The creator, Carter Bryant, created the Bratz line when he working at Mattel, which would make his ideas owned by Mattel. Bryant sold the idea to MGA and and the rest is history.
Bryant says he was between stints at Mattel when he thought of the idea, which sounds like a pretty weak defense to us, especially in light of the fact that MGA went out of its way to hide the fact that Bryant was the creator of the line. Now Mattel wants its Bratz idea back. The case is set for a jury trial and it's going to get ugly: the toy business is absolutely ruthless. Here's a sum up:

Barbie's Battle for Internet Supremacy
The toy business is a brutal one. CNET reports on Barbie's big battle for Internet supremacy. Although Barbie outsells other dolls, it is facing stiff competition online from virtual worlds that are aimed at young girls. In fact, Barbie's biggest competitor online right now is a group of virtual penguins.
Certainly, Mattel has tried to keep its brands Internet-savvy for more than a decade. Mattel's Barbie.com and EverythingGirl.com have the highest concentration of girls age 2 to 11 on the Web, according to researcher Nielsen NetRatings, but their overall audience hasn't grown much over the years.
The company is also being pressured by toys like Webkinz and an avalanche of virtual worlds designed for kids. Bratz, for example, the racier fashion dolls that have eaten into Barbie sales in recent years, plans to launch a virtual world called Bratz World (Be-Bratz.com) and a Rescue Pets (my e-pets.com) this summer.
"Mattel is the 800-pound gorilla in the toy industry, and it's worked hard to continually reinvent itself," said Lisa Bradner, senior analyst at Forrester Research. "I think they'll continue to be a very strong player, but it's hard to innovate at the speed and agility that a company like Webkinz can."
The overall audience for Barbie sites has declined slightly over the last year, and has failed to grow over the last three years. According to Nielsen NetRatings, the Barbie site attracted about 1.9 million unique visitors from home and work in April 2007, down from 2.1 million in April 2006. Those numbers are in line with about 2 million visitors in the same month in 2004.
In contrast, Webkinz--plush pets with corresponding virtual homes on the Web--have exploded in popularity over the last year. In April, Webkinz attracted 3.6 million unique visitors from home and work, up from just 285,000 a year before. Webkinz has even usurped the long-reigning virtual pets site of the Web--Neopets, which went from 2.6 million unique visitors in April 2006 to 3.2 million in 2007.
Another major contender in the kids category, ages 2 to 11, is Club Penguin, a virtual community of penguin avatars for children. It drew more than 4 million unique visitors in April. And Disney.com, the generalist playground of Mickey Mouse and other characters, attracted more than 11 million visitors that month.
Can Barbie hold off the hordes of adorable invading penguins and scantily-clad, big-headed Bratz dolls? We certainly hope so. We have soft spots in our hard little hearts that are reserved just for Barbie. But don't tell anyone. Especially those trashy-looking Bratz girls.

Funky Bratz Style Now Shapes Electronics and Furniture
Bratz doll manufacturer MGA Entertainment is now focusing the
immensley popular Bratz girl brand on bedding, children's furniture and electronics. CNN reports that MGA already offers a Livin' Bratz home decor collection, which includes "stylish pillows, a pink bed canopy, folding chairs and funky desk clocks. For the outdoor type, there's even a Bratz 20-inch fashion bike and a scooter." Bratz Electronic Funk products include a TV/DVD player, chill-out fridges, boomboxes, earmuff headphones and lipstick shaped
MP3 players.

Yahooligans Names Year's Hottest Toys
Yahooligans, Yahoo!'s Web guide for kids, has announced the results of the
2004 Top Ten Toys poll. More than 185,000 kids throughout the United States voted and chose the Honda Minimoto Maxii, an electric mini-motorcycle that kids can ride, as the most sought-after gift this holiday season. Other mentions in the Yahooligans Top Ten included VideoNow Color, Bratz Tokyo-A-Go-Go Dance, Hershey's S'mores Maker, ESPN Gamestation (this was also mentioned recently on the Today Show), and Fur Real Friends Love Cub.

Topping Toy Shopping Lists: Barbie, Bratz, Games and Spiderman
An NRF Holiday survey has found that people shopping for boys are
most interested in video games, spiderman merchandise and remote control toys. Topping
wish lists of people buying for girls were Barbie merchandise (21.7%),
though many parents will also be hunting for Bratz dolls (16.5%). Other popular toys for
girls include video games, Leap Frog, Dora the Explorer, Care Bears,
and Cabbage Patch Kids. Nearly one in five people (19.9%) purchasing a gift for a boy this year will be searching for a video game. The survey also indicated that Spiderman merchandise will be in high demand (8.9%) with remote control toys, cars, trucks, and Hot Wheels following closely behind.

Yahooligans, Yahoo's web guide for kids, has found that most kids are interested in electronic games as gifts this holiday season. Yahooligans polled 132,000 kids to find their top pics. Top Ten Xmas Toys in England
The DailyRecord reports that the British Association of Toy Retailers' has come out with a list of Top 10 Christmas toys for 2003. The old Teenage Mutant Ninja Turtles are back again -- they were incredibly popular back in the 1980s. Other toys on the top ten list include My Little Pony, Barbie, Bratz, Badge It and Legos.
